Terms and Conditions

These Terms and Conditions ("Terms") are a binding agreement between you ("you," "User," or "your") and [LEGAL ENTITY NAME] ("AwaraBuddy," "we," "us," or "our").

These Terms apply when you access or use any AwaraBuddy brand property, including our mobile applications (Android and iOS), website at awarabuddy.com, waitlist and pilot forms, social media accounts, newsletters, and customer support (collectively, the "Services").

By using the Services, creating an account, joining a waitlist, or checking "I agree" in the app, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

You may use the Services only if you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter a binding contract.

What AwaraBuddy is

AwaraBuddy is a group-riding coordination tool that helps riders create and discover group rides, see who has joined, track shared expenses, manage profiles, and receive ride notifications.

What AwaraBuddy is not

AwaraBuddy is not a transportation, taxi, ride-hailing, or delivery service; not a travel agency; not an emergency response service; and not an insurer or payment escrow provider (except where explicitly stated for a specific paid feature). We do not employ ride hosts or control how rides are conducted on the road.

Your account

You may sign in using Google Sign-In or use limited features without signing in. You are responsible for maintaining the security of your credentials and all activity under your account. You may not create multiple accounts to evade restrictions or misrepresent your identity.

Prohibited conduct

You agree not to: use the Services unlawfully; harass or threaten other users; post false ride or expense information; impersonate others; scrape or reverse-engineer the Services; upload malware; circumvent security controls; or collect other users' personal information without consent.

Roles

• Captain (host): The user who creates and manages a ride.
• Participant: A user who joins a ride.

Captain responsibilities

If you host a ride, you are solely responsible for planning, leading, and conducting it. You must provide accurate ride details, communicate changes in good faith, and comply with all applicable traffic, licensing, insurance, and safety laws. AwaraBuddy does not verify your riding skill, vehicle condition, insurance, or license.

Participant responsibilities

If you join a ride, you voluntarily accept the risks of group riding. You are responsible for your own vehicle, gear, fitness, and legal compliance. You may leave a ride before it starts, subject to in-app rules.

Ride lifecycle

Rides may be upcoming, live, completed, expired, or cancelled. Captains have exclusive rights to start, end, or cancel rides they host. Automated rules (e.g. expiry if a ride is not started on time) may apply. We do not guarantee that any ride will occur or that participants will attend.

Emergency contacts you store in your profile are optional and not automatically shared with all users. You represent that you have permission to provide those contacts' details. AwaraBuddy is not responsible for failures to notify emergency contacts due to network issues, device settings, or third-party outages.

The Services allow users to record shared expenses (fuel, food, tolls, etc.) and view summaries or splits. Expense entries are user-generated and for coordination purposes only.

We do not guarantee the accuracy of expense records. Disputes over amounts owed are between users. Unless explicitly stated otherwise, AwaraBuddy is not a party to private payment arrangements between riders.

During pilot or early phases, payment-related features may be disabled, limited to ledger-only tracking, or available only to approved pilot Captains.

Where paid join fees or in-app payments are enabled:

• Additional payment terms may apply and will be shown at checkout.
• Payments may be processed by third-party payment providers.
• Refunds and disputes may be subject to provider rules and our stated refund policy.
• We may block payment features for users who violate policies (e.g. repeated no-shows).

You are responsible for any taxes arising from payments you make or receive in connection with rides.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RIDE WILL BE SAFE OR SUCCESSFUL.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [LEGAL ENTITY NAME] AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, ANY RIDE, ACCIDENT, INJURY, OR PROPERTY DAMAGE, OR CONDUCT OF ANY USER OR THIRD PARTY.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF INR 1,000 (OR equivalent) OR THE AMOUNT YOU PAID TO AWARABUDDY IN THE 12 MONTHS BEFORE THE CLAIM.

Indemnification

You agree to indemnify and hold harmless [LEGAL ENTITY NAME] from any claims arising from your use of the Services, your User Content, your organization or participation in rides, or your violation of these Terms or applicable law.

Intellectual property

The Services, including the AwaraBuddy name, logo, design, and software, are owned by us or our licensors. You receive a limited, non-transferable license for personal, non-commercial use. You retain ownership of your User Content but grant us a license to operate the Services as described in our Privacy Policy.

Beta and pilot features

AwaraBuddy may be offered in pilot or beta form. Features may be incomplete, change without notice, or be removed. You use pilot features at your own risk.

We may suspend or terminate your access if we reasonably believe you have violated these Terms, misused the Services, engaged in fraud or illegal activity, or posed a safety risk.

You may stop using the Services at any time by logging out and uninstalling the app. Some data may be retained as described in our Privacy Policy. Third-party services (Google Sign-In, Firebase, Google Places, payment processors) are subject to their own terms.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in [City, State, India] shall have exclusive jurisdiction, subject to mandatory local consumer protection laws.

Before filing a claim, you agree to contact us at legal@awarabuddy.com and attempt informal resolution for at least 30 days.

We may modify the Services or these Terms at any time. We will post updated Terms on awarabuddy.com/terms and update the "Last Updated" date. For material changes, we may notify you via the app, website, or email. Continued use constitutes acceptance.
